These Terms of Service govern access to and use of Harmonize Health's services, software, and websites. By accessing or using the Services, you agree to these Terms on behalf of your organization.
Who may use the Services
You must be an independent healthcare practice or other healthcare organization authorized to enter into contracts. If you use the Services for a practice, you represent that you have authority to bind that organization.
Services and patient data
The Services support appointment scheduling and basic patient information for covered healthcare practices. We handle patient data only as permitted under our Business Associate Agreement (BAA) and applicable HIPAA requirements. The BAA is incorporated into these Terms by reference.
SMS Messaging Program
Harmonize Health provides SMS messages related to patient care and appointment schedules.
Sign-up method: Users opt in through the web form available at /forms/sms-consent.
CTA used on that form: By checking the box above and submitting this form, you consent to receive SMS messages from Harmonize Health related to your care and/or appointment schedule. Msg & data rates may apply. Msg frequency varies but should be a dozen messages a week. Unsubscribe by replying STOP. Reply HELP for help. Phone numbers and mobile opt-in data are not shared with third parties or affiliates for marketing or promotional purposes. Your responsibilities
- Ensuring the accuracy of information you provide.
- Maintaining appropriate consents and authorizations.
- Complying with applicable laws and professional obligations.
- Controlling user access to your account.
Acceptable use
You will not use the Services to violate law or professional rules, access data you are not authorized to access, or interfere with the security or availability of the Services.
Fees and billing
Fees, billing terms, and any service levels are set out in a separate order form or agreement between us. If none apply, the Services are provided without charge.
Intellectual property
We retain all rights in the Services. You receive a limited, non-exclusive, non-transferable license to use the Services during the term.
Suspension and termination
We may suspend or terminate access if required by law, if you materially breach these Terms or the BAA, or to protect the security of the Services. Either party may terminate as set out in the applicable order form or agreement.
Disclaimers
The Services are provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Services do not provide medical advice.
Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability under these Terms is limited to the amounts paid by you for the Services in the 12 months before the event giving rise to the claim.
Governing law
These Terms are governed by the laws specified in your order form or agreement. If none is specified, the laws of the state where Harmonize Health is located apply, without regard to conflicts of law.
Changes
We may update these Terms by posting an updated version. Material changes will take effect on the effective date shown above.
